The original Terms and Conditions of this Site, in Spanish, are accessible here: https://www.servorum.com/terminos-y-condiciones.  In the event of any contradiction between the original Spanish version of these T&C and any version in another language, the Spanish version shall always prevail.

Welcome to Servorum.com ("the Site"). These Terms and Conditions of Service ("T&C") govern the use of our platform and services. By accessing or using Servorum.com and the links contained within the Site, you agree to comply with these T&C and confirm that you have reached the age of majority in your country. If you do not agree with any part of these T&C and/or have not reached the age of majority in your country, please do not use our services.

1. About Servorum.com

Primary Mission: Servorum.com's mission is to connect companies and candidates, consultants, and self-employed professionals who abide by the following values:

a) Respect for the dignity of the human person in all stages and dimensions of life; b) honesty in actions and words; and c) excellence in work and professional conduct , hereinafter referred to as "the Values", with companies guided by the Values, in order to develop working relationships built on mutual trust and integral growth.

Our Role: To connect people and companies aligned with the Values through recruitment and personnel selection services.

Legal Structure: "Servorum" and "Servorum.com" are trade names (DBA) under which Pedro Cadena Díaz, an individual, operates. Servorum is not currently incorporated as an LLC, corporation, or any other separate legal entity. Pedro Cadena Díaz is the sole owner and operator of the Site and personally assumes responsibility for the services described herein. All payments referenced in these T&C are made directly to Pedro Cadena Díaz as an individual, not to a corporate entity.

2. Site Users

Our services are directed at:

Clients: Business owners guided and abiding by the Values who are seeking talent aligned with the Values to fill their open positions.

Candidates: Professionals and other workers who recognize, respect, and live by the Values.

3. Description of Service

We facilitate connections by:

Collecting detailed hiring needs from companies.

Filtering and curating candidates based on official documentation, references, and an interview process conducted by properly trained personnel.

Presenting job openings to candidates, and profiles of candidates, consultants, and self-employed professionals to companies.

4. Relationship with Servorum and Evaluation Process

You authorize Servorum to conduct a thorough evaluation process, including verification of information, interviews, and references.

Your profile is presented confidentially only to client companies that have been pre-vetted for alignment with the Values.

5. Limitation of Liability

Servorum does not guarantee employment or job performance. The final hiring decision rests solely with the company.

We are not a party to any employment contract between a company and a candidate.

As stated in Section 1, Servorum is a trade name under which Pedro Cadena Díaz operates as an individual; it is not a separate legal entity. References to "Servorum" throughout these T&C refer to Pedro Cadena Díaz personally, in his capacity as the sole owner and operator of the Site.

6. Fees and Payments (For Companies)

Initial Payment (Retainer): To begin each search, the client shall make a search-activation payment (retainer) of $1,000 USD to Pedro Cadena Díaz. This payment will be credited toward the success fee in every instance, without exception.

Success Fees: Upon hiring a candidate presented by Servorum, the client shall pay Pedro Cadena Díaz, within 30 calendar days after the invoice is issued, the remaining amount needed to make up the difference between the retainer and one month of the hired candidate's gross salary.

Minimum Fee: If the candidate's monthly salary is less than or equal to $1,000 USD, a retainer of $500 USD will be charged at the start of the search, and a success fee of $500 USD will be charged within 30 calendar days after the invoice is issued, such that the minimum total payment to Pedro Cadena Díaz in these particular cases will be equal to $1,000 USD.

Pedro Cadena Díaz will issue the corresponding invoice.

7. Replacement Guarantee (For Companies) and Candidate Exclusion

Standard Guarantee (6 months): Free replacement in the event of a justified dismissal due to a serious violation of the Values (e.g., dishonesty).

Extended Guarantee (12 months): Activated upon an additional payment of $250 USD, payable at the time the success fee is collected. This guarantee provides for a free replacement if the candidate voluntarily resigns within the first 12 months after being hired.

No Refunds: Payments made to Servorum are non-refundable, as they correspond to the execution of the search, evaluation, and candidate-presentation process. If the Client decides not to hire any of the candidates presented during a search, the amount of the initial payment will be recorded as a credit in the Client's favor for a new search under equivalent conditions, redeemable within the following 12 months, counted from the conclusion of the original search.

Candidates who are justifiably dismissed will be permanently blocked from the Servorum international candidate network.

8. User Obligations

Companies: Provide truthful information, notify Servorum of any hires, fulfill payment obligations, and act in accordance with the Values.

Candidates, Consultants, and Other Professionals: Provide truthful and up-to-date information, and act in accordance with the Values.

9. Personal Data and Privacy

We collect personal and professional data that you voluntarily provide.

We use this data exclusively to evaluate companies, business owners and candidates, present job openings to candidates, present profiles of candidates and other professionals to companies, and communicate with you about the process.

We share data only with pre-vetted client companies. We do not sell data to third parties.

You may request access to, correction of, or deletion of your data by contacting recruiting@servorum.com.

10. Data Security

We use third-party providers (e.g., Google, Meta, Squarespace) for essential functions, all of which maintain high security standards. While we implement reasonable measures, we do not guarantee absolute security.

11. Modifications to the T&C

We reserve the right to modify these T&C at any time. Modifications will become effective upon being published on the Site.

12. Governing Law and Jurisdiction

These T&C are governed by the laws of the State of Nuevo León, Mexico. Any dispute shall be submitted to the competent courts of Monterrey, Nuevo León.

13. User Consent

By using the Site, the user confirms that they have read, understood, and accepted these T&C, and consents to the use of their data as described herein.
